These conditions of sale are concluded on the one hand by the Seller, on the other hand, by any natural or legal person wishing to make a purchase via the Site, hereinafter referred to as the Customer. The Customer adheres to these general conditions by placing an order or registering on the Site. It is up to the Customer to take this into account before any purchase, order or registration. The Customer must be at least 18 years old in order to register or place an order on the Site.
Article 1: object
These conditions of sale aim to define the contractual relationship between the Seller and the Customer and the conditions applicable to any purchase made through the Site. The acquisition of a product or service through this site implies unreserved acceptance by the Customer of these conditions of sale, which the Customer acknowledges having read prior to his order. Before any transaction, the Customer declares on the one hand that the purchase of products on the Site is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing him to commit to these general conditions of sale.
The Seller retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the Customer.
Article 2. Products and services
The products and services offered are those which appear on the Site. The Seller reserves the right to modify the assortment of products and services at any time. Each product and service is presented on the website in the form of a description containing its main technical characteristics. The photographs are as accurate as possible but do not bind the Seller in any way. The sale of the products and services presented on the Site is intended for all Customers wishing to learn French and residing in countries which fully authorize the entry into their territory of these products.
The Customer can purchase course packs directly from the site. Once the order has been placed, he will have to take all of his lessons before the expiration date, otherwise they will be considered expired and can no longer be scheduled. Course packs are not refundable which means all lessons have to be taken. Rescheduling requests by the Customer will be accepted if made by email to the following address contact@jeromevanbaelinghem.com twenty-four hours before the beginning of the lesson. A new date will then be chosen. There will be a 15 minute tolerance if the Customer does not attend the lesson at the scheduled time. After this time, the course will be considered given. Indeed, the programming of a course implies the preparation and the presence of the Seller at the given time, therefore the impossibility for other Customers to book. The Seller reserves the right to cancel a course at any time and will propose a new date.
Article 3. Rates
The prices appearing on the product sheets of the internet catalog and are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products. The Seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer.
Article 4. Order and terms of payment
Before any order, the Customer can create an account on the Site. At each visit, the Customer, if he wishes to order or consult his account (order status, profile, etc.), must identify using this information. The Seller offers the Customer to order and pay for his products in several stages, with 3 payment options to choose from. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport on the network. Any guarantee as to the security of this system is entirely the responsibility of the aforementioned companies and cannot be imputed to the Seller.
Secure payment by PayPal, credit card (via the Stripe system) or Alipay: the Customer selects the products and services he wishes order then chooses the method of payment of his choice. Finally, the Customer is redirected to the PayPal secure interface in order to securely enter his personal credit card PayPal account references. If the payment is accepted, the order is recorded and the contract definitively formed. Payment by Paypal, credit card or Alipay is irrevocable. In the event of fraudulent use of the latter, the Customer may demand the cancellation of the payment by card, the sums paid will then be credited or returned. The responsibility of the holder of a bank card is not engaged if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest, in writing, the direct debit from his bank, within seventy days following the transaction, or even one hundred and twenty days if the contract binding him to the latter so provides. The amounts withdrawn are reimbursed by the bank within a maximum period of one month after receipt of the written dispute filed by the cardholder. No cost of restitution of the sums can be charged to the holder.
The confirmation of an order entails acceptance of these conditions of sale, the recognition of having perfect knowledge of them and the renunciation of availing oneself of its own conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the Customer has an e-mail address and if he has provided it on his order form, the Seller will send him by e-mail confirmation of the registration of his order.

Article 5. Retention of title
The Seller retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.
Article 6. Right of withdrawal
Under Article 103 of the Law on the Defense and the Rights of Consumers and Users, there will be no right of withdrawal and the Customer declares to be informed of this exception and the accept in contracts concerning: digital content (in classic or online format) other than in material form if the performance has begun with the express prior consent of the consumer and, informed that following this, he or she loses his right of withdrawal .
If the customer has purchased any of the products or services on the website, mentioned above as exceptions to the general norm, he or she will not be able to exercise his right of withdrawal according to the provisions of said article 103 of the Law on Defense and Rights of consumers and users.
Article 7. Liability
The Seller in the distance selling process is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
Article 8. Intellectual Property
All elements of the Site are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.
Article 9. Personal data
The Seller undertakes to preserve the confidentiality of the information provided by the Customer, which he would have to transmit for the use of certain services. Any information concerning him or her is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him.
